No problem I am just guessing Lucasarts probably have a separate name in mind anyhow haha and it would be all for nothing
Yeah I am not trying to be insulting, all I said was in the beginning is, unless he produces a website on that domain name, it will be considered cybersquatting and all the above will apply
If you re-read my original post thats exactly what I stated, your kinda echoing whats already been stated
As for the not existing argument, KOTOR exists and as such is a trademarked name, as such is considered copyrighted. The same as Yahoo is copyrighted you can't make a website called Yahoocool or YahooOnline, simply because Yahoo the actual word or abbreviation is copyrighted and thus is encompassed by the legal rights of Yahoo
Its all stated in the post I made, even names similar to Yahoo were considered against Yahoo's rights, such as Yahoa or such names
It just depends on the company and far they are willing to take it, in the case of Diablo3.net I would have advised Blizzard to just leave it alone as it is good publicity and is a functional site, it can only but BENEFIT sales of Diablo3
However www.kotor-online.com has nothing on it
Anyway who cares Lucasarts will probably choose a different name for it anyhow
I think you will find they have registered KOTOR as a trademark, as in LUCASARTS has not Bioware, Bioware just develop and make the game, Lucasarts provides them with the licence to do that and then publish the game for them
And I quote from the Bioware site:
STAR WARS®: KNIGHTS OF THE OLD REPUBLIC™: © 2001 LucasArts Entertainment Company LLC. © 2001 Lucasfilm Ltd. & TM or ® as indicated. All rights reserved. Used Under Authorization. LucasArts and the LucasArts logo are registered trademarks of Lucasfilm Ltd.
The little c means COPYRIGHTED
They can take it from him as it is considered stealing copyright
UNLESS he makes a site on that domain, it will be considered CYBERSQUATTING, I will quote what can be done
"If you own a trademark and find that someone is holding it hostage as a domain name until you pay a large sum for it, you may be the victim of cybersquatting. You can either sue to get your domain name -- and possibly some money damages -- under a 1999 federal law known as the Anti-Cybersquatting Consumer Protection Act, or you can initiate arbitration proceedings under the authority of the Internet Corporation of Assigned Names and Numbers (ICANN) and win the name back without the expense and aggravation of a lawsuit."
Either way LUCASARTS have DEEEEEEP pockets and if you went to court they sure as hell would win and you would have to pay ALOOOOOT in legal fees
Good luck
If you don't believe me check this:
"The World Intellectual Property Organisation (WIPO) has transferred 37 domain names to Yahoo! because a group of individuals and companies registered names that were identical or confusingly similar to the trade marks owned by the internet portal.
The dot.com names registered included AYAHOO, JAHU, NYYAHOO, YAHOOF, YAHOONY YOUHOO and YAHPOO.
Yahoo! had trade and service mark registrations for the word “Yahoo!” in the classes of computer software for search and retrieval, books, computer services, magazines, posters, shirts, etc. The original domain name was registered in 1995.
The company claimed that the similar domain names were registered mostly by one individual, Eitan Zviely, under a number of fictitious company names. It said he was “a known cybersquatter”.
WIPO found that the Zviely and the other parties had no legitimate interests in the names and that they were registered in bad faith. It ordered that the registration of the 37 names be transferred to Yahoo!
Yahoo is also planning on filing a lawsuit in Thailand against Yoohhoo.com, a Thai based site. According to reports, the site’s owners claim “it is simply a spelling of the yoo-hoo sound people make to attract the attention of someone they know.”"
This cybersquatting worked in the past when it was a new phenomenon and there were no legal rules in place, but this is the 21st Century and laws have been made to protect companies and their trademarks etc
Been playing Guild Wars again alot and I always had a few problems seeing as the game is quite mature now
I love PvP and always wanted to get into the Guild Wars PvP, however I have usually resigned myself to playing the PvE aspect of the game and then missed out on the PvP
This is mainly because I feel a little intimidated at the sheer number of classes and skills that can be used in the game, and I don't really want to end up making a fool of myself in a PvP battle
Any pointers for a new person on how to break into the PvP game or it best to get through the PvE aspect as well?
Oh and one other question is it worth getting The Eye of the North expansion if you have never really got a character to lvl 20 of the PvE aspect of GW?
Thanks in advance
