Your perception is misleading you. You assume that by "open beta" they meant open-to-the-general-public beta, and that is not the case at all.
If you preorder, you can get into the open beta. The beta is open to those who preorder -- and since ANYONE CAN preorder -- if they want to -- by definition, it becomes an open beta.
If you don't want to preorder, that is your decision, but you COULD preorder if you choose to, making the beta OPEN to you. Your choice, your decision.

It is you who are clouded. Open beta is commonly used to refer to a public access. It should be called early access beta because it's a beta with a catch.
Now i used "commonly" which doesn't mean the ultimate meaning.
